Participant’s Acknowledgement of Risk and Waiver Form (including Release, Indemnity and Conditions of Entry ) for the “Walk for Prems” Walk/Fun Run fundraising campaign of Life’s Little Treasures Foundation Ltd (ABN 94 232 874 269) (LLTFL)

In this Acknowledgement:

Acknowledgement means this Participant’s Acknowledgement of Risk and Waiver Form.

Event means the “Walk for Prems” Walk/Fun Run conducted by LLTFL or the Releasees, whether it be the 5km walk, or 5km run and at whatever Venue it is conducted.

Participating Minor means any child under the age of 18 for which a parent or guardian registers in the Event. 

Private Event means a “Walk for Prems” Walk/Fun Run, whether it be a 5km walk or social walk/run, conducted privately by a person, company, organisation or any other party other than LLTFL or the Releasees with the permission of LLTFL or the Releasees.

Registration means an online registration completed by you on the LLTFL website www.walkforprems.org.au, either on behalf of yourself, a Participating Minor, or both or you, and registering the names of the persons (including you, the Participating Minor or both of you) intending to take part in the Event or Private Event.  

Releasees means LLTFL, its servants, agents, affiliates, members, sponsors, promoters, volunteers and any person or body directly or indirectly associated with the Event or Private Event.

Venue means Melbourne, Sydney, Canberra, Adelaide, Brisbane, Perth, Hobart, Townsville, Cairns, and Ballarat and any other location at which an Event or Private Event is conducted. 

Unless the context otherwise requires, words importing the singular include the plural and vice versa and words importing a gender include the other gender.

By completing a Registration, you are acknowledging and confirming that:

• you have read and understood the ‘General Information’ for the Event and Private Event;
• you have read, understood and agree to the terms and conditions in this Acknowledgement for and on behalf of each party named in the Registration;
• you agree to comply with all rules and directions made by LLTFL in connection with the Event and Private Event;
• you understand that you are compromising and waiving legal rights, including rights you may have against the Releasees; and
• with this in mind, on behalf of yourself and your heirs, executors, administrators and the Participating Minor, you agree and/or certify as follows:

1. If I am registering any Participating Minor, I am the parent or guardian of that Participating Minor.
2. I agree to maintain effective and dedicated supervision over any Participating Minor that I register and to take full responsibility for supervising the Participating Minor at all times during the Event or Private Event, whether the Participating Minor is walking, running, or riding a bicycle or scooter.
3. In my judgment, I and any Participating Minor have sufficient fitness and ability to participate in the Event or Private Event.  
4. I am not aware of any pre-existing medical condition which may increase my risk or the risk of any Participating Minor suffering injury, loss or damage or which would prevent me or any Participating Minor from safely participating in the Event or Private Event.  
5. No physician, surgeon, doctor or other licensed health care practitioner has advised me, after due inquiry, that I or any Participating Minor should not participate in the Event, Private Event or a like activity.
6. I have disclosed any pre-existing medical or other condition that may affect the risk that I or any Participating Minor will suffer injury, loss or damage I am aware that LLTFL relies on the information provided by me and I state that all such information is accurate and complete.
7. I acknowledge that it is a condition of my or any Participating Minor’s participation in the Event or Private Event that I or any Participating Minor do so voluntarily and at our own risk.  I acknowledge that in doing so, the risks to me or to any Participating Minor of participating in the Event or Private Event include risk of injury from exercise, risk of coming in contact with barriers or other objects, risk of being hit by a cyclist or other participant, risk of injury from the track and surrounding environment, risk of collision with a spectator or an official, sun damage or other physical injury.
8. I understand and acknowledge that not all risks can be predicted and that I or any Participating Minor may face harm by taking part in the Event or Private Event, resulting in serious personal injury (including permanent disability) or death.  I also understand that any personal injuries I or the Participating Minor suffer may be compounded or increased by not only my or the Participating Minor’s actions but from the actions, omissions or negligence of others.
9. I have discussed the risks of participating in the Event or Private Event with any Participating Minor and, being fully informed, I voluntarily agree to accept and assume responsibility for all risks, dangers and hazards which the Participating Minor may face in connection with participation in the Event or Private Event.
10. I and any Participating Minor acknowledge, agree to, and voluntarily assume all risks of any harm, injury or damage that we may suffer to our person or property whether foreseen or unforeseen in connection with the Event or Private Event.
11. I and any Participating Minor further acknowledge and agree that the risks inherent in our participation in the Event or Private Event are obvious risks, of which personal injury, loss, liability and/or damage are common and ordinary consequences and we assume and accept all such risks and waive our right to bring against the Releasees any action, suit, claim, demand or proceedings in respect of personal injury, loss or damage suffered by me or any Participating Minor or caused by me or any Participating Minor to any other person whether arising from any negligence on the part of the Releasees or any other cause.
12. To the maximum extent permitted by law, I and any Participating Minor agree to release and forever discharge the Releasees from any and all liability to me or any Participating Minor in negligence, breach of contract or breach of statutorily implied warranties or duties for any personal injury, loss or damage (whether direct, indirect or consequential) suffered by me or any Participating Minor in connection with or arising out of the Event or Private Event.
13. I agree to indemnify the Releasees and each of them against all actions, proceedings, claims, demands, costs, expenses or liability whatsoever in respect of all injury, loss or damage of whatever kind I or any Participating Minor might suffer as a result of my acts, omissions or negligence  or that of any Participating Minor, or any acts or omissions, whether negligent or otherwise,  of the Releasees or any of them in the course of or arising out of the Event or Private Event.
14. I acknowledge that, to the maximum extent permitted by law, LLTFL makes no representation as to the suitability of the Event or Private Event for me or any Participating Minor.
15. I consent to me or any Participating Minor receiving whatever medical treatment or emergency care that  may be necessary or advisable for the treatment of any  illness or injury that may be suffered by me or any Participating Minor during the course of my or any Participating Minor’s participation in the Event or Private Event.
16. I hereby give LLTFL and those acting with LLTFL’s permission the irrevocable right to use and/or copyright images of me or any Participating Minor in all forms and media and in all manners including alterations and composite representations, to promote the Event or Private Event without restriction and without compensation to me or any Participating Minor. 
17. I or any Participating Minor waive any right to inspect or approve the finished photograph(s) or image(s), or any copy that may be used in connection with the photograph(s) or image(s), or the use to which it is applied.
18. I agree to allow any data which is collected by way of the Registration to be used for any promotion of the Event or Private Event and the charitable work of LLTFL.  I also agree for this data to be forwarded to any person or body directly associated with the Event or Private Event.
19. Where I am the organiser and/or host of a Private Event, I agree to indemnify the Releasees against any actions, proceedings, claims, costs and demands for any personal injury, loss or damage (whether direct, indirect or consequential) suffered by any person attending the Private Event.
20. Should the Event or Private Event be cancelled for any reason whatsoever I understand that entry fees will not be refunded and that no liability of any kind will attach to the Releasees or any of them or a person, corporation or body involved otherwise engaged in promoting or staging the Event or Private Event. I also understand should the event be cancelled due to COVID-19 my registration converts to a virtual registration with no refund for any price difference.
21.  If a Venue permits dogs, I agree to maintain effective and dedicated supervision over any dog(s) that I or any Participating Minor take, to keep the dog(s) on a leash at all times and to take full responsibility for supervising the dog at all times during the Event or Private Event.  I acknowledge, agree to, and voluntarily assume all risks of any harm, injury or damage that any dog(s) may suffer whether foreseen or unforeseen in connection with the Event or Private Event and waive my right to bring against the Releasees any action, suit, claim, demand or proceedings in respect of injury, loss or damage suffered by any dog or caused by any dog to any other person howsoever arising and indemnify the Releasees against any action, suit, claim, demand or proceedings in respect of injury, loss or damage suffered by any dog or caused by any dog to any other person howsoever arising.
